To assist students, employees, and the Southern University Baton Rouge campus community in understanding and navigating the University’s Title IX Grievance Process the following information is provided.  As the first step in the Title IX Grievance Procedure, which addresses allegations of Title IX Sexual Harassment subject to the Title IX Regulations adopted by the U.S. Department of Education (USDOE) and the Southern University System, effective August 14, 2020, one must report such allegations to the SUBR Office of Title IX.  Conduct that falls outside the scope of the Title IX Regulations set by USDOE (i.e., power-based violence) may be addressed by applying the Southern University System Policy on Power-Based Violence, Sexual Misconduct, and Title IX.  The Title IX Grievance Procedure and its terms supersede any policies pertaining to the investigation or adjudication of “sexual harassment” as defined in this protocol.

Any member of the Southern University and A&M College may report an alleged violation of the Southern University System Uniform Policy on Power-Based, Violence, Sexual Misconduct, and Title IX. To Make a Formal Complaint

Any member of the Southern University community, guest, visitor, or other interested parties may make a report of an alleged violation of Southern University System Uniform Policy on Power-Based, Violence, Sexual Misconduct, and Title IX.

Formal complaints (found under the "make a complaint" button below) must be completed using a system identification number (or U number), be in writing, and be signed by the Complainant.  It is suggested for the preservation of evidence that all reports or formal complaints are submitted within one hundred and twenty (120) calendar days following the date of the alleged incident of sexual misconduct. Formal complaints submitted after 120 calendar days will still be investigated.  While Southern University is firmly committed to protecting all members of the campus community from sexual-based misconduct, failure to file a timely complaint may adversely affect the ability of Southern University to take appropriate actions under this policy.  Formal complaints must be submitted in writing.  A complainant or reporter can call to make arrangements for a representative to meet with them at another location to process the filing of a formal complaint. Individuals that are unable to file a written complaint and would like to make a verbal complaint can call the Title IX Office to make arrangements.  Be advised that in order for a complaint to be official, it must be in writing.

 

 

Sexual misconduct, particularly sexual violence, may be a crime. Southern University will assist complainants who wish to report sexual misconduct to the Southern University Police Department. Representatives of the Office of the Dean of Students and the Office of Human Resources are available to assist students in reporting to SUPD. SUPD will also assist complainants in notifying other law enforcement authorities in other jurisdictions, as appropriate.

Campus Confidential designees are not obligated to report incidents of sexual misconduct to the Title IX Coordinator or law enforcement in a way that identifies a complainant or respondent unless otherwise required to do so by law. Each office shall, to the extent authorized under law, provide confidential services to students.

 

Non-Retaliation Policy:  Retaliation against any person who alleges a violation of the Gender-Based Sexual Misconduct Policy or who reports or assists SUBR in the investigation of a complaint under this policy may result in disciplinary action up to and including termination or expulsion by SUBR. Retaliation against any person who is the Complainant/victim of sexual misconduct is prohibited as well. There will be no retaliation against those who report or assist the SUBR campus in the investigation of a complaint. Retaliation against the Complainant/victim or witnesses may warrant a separate University judicial process hearing.
